Elmira Councilman Faces Charges For Alleged Bar Fight

ELMIRA, N.Y. (WETM) – An Elmira City Councilman has been charged by police in connection to a bar fight in February.

Elmira Police announced that District 5 Councilman Tory Kitching was charged with assault in the third degree, a misdemeanor in connection to a fight at WMC North on February 18, 2023. 

Kitching, who not be running for reelection this year, declined to comment when asked in March about the incident. 18 News spoke with an eye witness who claimed that Kitching allegedly assaulted the owner of the bar after getting into an argument.

In a statement, Chemung County Democratic Committee Chair Dora Leland says, "The people of his district expect a representative to listen to their concerns and share them in the city council. He's not doing that. Worse yet, he's collecting a paycheck from the taxpayers of the City of Elmira for work he's not doing."

Mayor Mandell spoke on the matter as well saying, "The bottom line is he's an elected official. He doesn't have to show up to meetings, he doesn't have to go to council meetings. There's nothing that compels him to do that. Am I frustrated like the Democratic Committee? You're darn right."

In court Tuesday morning, Kitching pleaded not guilty. The judge also granted an adjournment for May 9th, where he will re-appear on the charges at 9 A.M. Both Kitching and his attorney declined to comment, when asked about the incident by WENY News.
